Harvesta – Terms and Conditions

Welcome to Harvesta, a global community garden marketplace connecting home growers with buyers. By accessing or using our platform, you agree to the following Terms and Conditions ("Terms"). Please read them carefully.

These Terms constitute a legally binding agreement between you and Synapze Interactive Pty Ltd ("Harvesta", "we", "us", or "our").

1. Overview

Harvesta is a peer-to-peer platform enabling home gardeners ("Sellers") to offer and sell their surplus produce to local community members ("Buyers"). While we facilitate connections, Harvesta does not participate in, manage, or guarantee any aspect of the transaction, including product quality, delivery, or payment.

2. Eligibility

You must be at least 18 years of age to use the platform. By registering or using Harvesta, you confirm that you meet this requirement and are legally capable of entering into binding agreements under the laws of your country of residence.

3. User Accounts

To access certain features, users must create an account. You agree to:

  • Provide accurate, current, and complete information.
  • Maintain the confidentiality of your account credentials.
  • Accept responsibility for all activities that occur under your account.

4. Listings & Transactions

  • Sellers may post listings with descriptions, images, and pricing of their produce.
  • Buyers can browse listings and contact sellers to arrange purchases.
  • All transaction details — including pricing, payments, and collection/delivery — must be handled directly between the buyer and seller.
  • Harvesta does not mediate or facilitate these exchanges.

5. Payments

  • All payment arrangements are the sole responsibility of the users involved.
  • Harvesta does not process, handle, or store any payment information.
  • Users must determine suitable and secure payment methods independently.
  • Harvesta is not liable for any losses, disputes, or damages resulting from payments.

6. Pickup & Delivery

Users must arrange pickup or delivery directly between each other. Harvesta does not offer delivery or transport services and assumes no liability for missed pickups, delays, or product condition.

7. Disputes & Refunds

  • Harvesta does not mediate disputes regarding produce, payments, or delivery.
  • Buyers and sellers are responsible for resolving any issues directly.
  • Harvesta does not provide refunds or enforce refund policies.

8. Acceptable Use

By using Harvesta, you agree not to:

  • List items that are non-homegrown, illegal, unsafe, or prohibited in your jurisdiction.
  • Mislead users with inaccurate listings or false information.
  • Harass, scam, or abuse others.
  • Interfere with the platform's security, stability, or functionality.

We reserve the right to suspend or terminate accounts at our sole discretion for any violations of these Terms.

9. User Content

  • You retain ownership of all content you post (e.g., images, text, descriptions).
  • By posting content, you grant Harvesta a non-exclusive, worldwide, royalty-free license to use, reproduce, display, and share your content for purposes related to the platform and its promotion.
  • You are solely responsible for the legality and accuracy of the content you upload.

10. Limitation of Liability

To the fullest extent permitted by law:

  • Harvesta is not liable for any user conduct, product quality, payment disputes, or losses arising from transactions.
  • The platform is provided "as is" and "as available" without warranties of any kind.
  • You use the platform at your own risk.

11. Termination

We may suspend or terminate your access to the platform at any time, with or without notice, if we believe you've violated these Terms or engaged in conduct that harms the platform or its users.

12. Privacy

We are committed to protecting your privacy. Please refer to our Privacy Policy for details on how we collect, store, and use your personal data.

13. Changes to These Terms

We may update these Terms from time to time. Where possible, we will notify you of significant changes. Continued use of the platform after changes are posted constitutes your acceptance of the revised Terms.

14. Governing Law

These Terms are governed by the laws of New South Wales, Australia, unless otherwise required by applicable local laws in your jurisdiction. Disputes may be subject to the exclusive jurisdiction of the courts of New South Wales, or as applicable in your location.
